NOTICE – Victoria No.1 Branch (‘Health Workers Union’ or ‘HWU Branch’) of the Health Services Union

The Health Services Union has applied to the Federal Court of Australia for a declaration under section 323 of the Fair Work (Registered Organisations) Act 2009 (Cth) that the Victoria No.1 Branch (‘Health Workers Union’ or ‘HWU Branch’) of the Health Services Union has ceased to function effectively, and there are no effective means under their rules by which it can be enabled to function effectively.

The Health Services Union has asked the Court to make an order approving a scheme to enable the HWU Branch to function effectively, under which:

  • all offices in the HWU Branch would be declared vacant;
  • an Administrator is appointed by the Court to administer the HWU Branch until the Administrator is satisfied that the HWU Branch is functioning effectively, or such other time as may be ordered by the Court;
  • the Administrator would hold, exercise and perform the powers and functions conferred by the rules of the Health Services Union on the HWU Branch and its Branch Officers for the period and upon the conditions prescribed by the scheme, which can be accessed via the following link:

Any person who wishes to be heard by the Court in relation to any order under section 323 of the Fair Work (Registered Organisations) Act 2009 in this matter may attend a hearing on 12 May 2025 at 11:00am (Australian Eastern Standard Time).

This hearing will take place in the Federal Court of Australia, in Victoria (Owen Dixon Commonwealth Law Courts Building, 305 William Street, Melbourne).

The court number will be published on the day in the court buildings, and will be accessible from the night before through the Federal Court’s website at Daily Court lists (fedcourt.gov.au).
